NOURISHER TERMS & CONDITIONS

These Terms & Conditions ("Terms") govern all purchases, deliveries, products, services, programmes and promotions offered by Nourisher through its website, mobile applications and any other sales channels.
By placing an order with Nourisher, creating an account, or using any of our products or services, you agree to be bound by these Terms.
These Terms do not affect any mandatory rights granted to consumers under Dutch or European consumer protection legislation.
1. Definitions
For the purposes of these Terms, the following definitions apply.
1.1 Account
A personal customer account created on the Nourisher Website through which Customers manage their orders, deliveries, preferences, rewards and account information.
1.2 Agreement
Any agreement concluded between Nourisher and a Customer relating to the purchase of Products or Services.
1.3 Customer
A natural person acting for purposes outside their trade, business or profession.
1.4 Curated Box
A pre-selected collection of Products assembled by Nourisher for a specific purpose or occasion.
Curated Boxes include, but are not limited to:

Birth Prep Boxes
-
New Parent Survival Boxes
-
Snack Boxes
-
Broth Boxes
-
Soup Boxes
Nourisher may introduce additional Curated Boxes from time to time.
1.5 Delivery
The delivery of Products to the address specified by the Customer.
1.6 Gift Card
A digital or physical gift card issued by Nourisher that may be redeemed in accordance with these Terms.
1.7 Meal Credit
A promotional credit issued by Nourisher.
Meal Credits:
-
have no cash value;
-
cannot be exchanged for money;
-
may only be redeemed on eligible Nourisher purchases;
-
expire in accordance with the applicable promotion unless otherwise stated.
1.8 Meal Plan
A curated menu consisting of multiple meals intended to cover one or more consecutive days.
Meal Plans may include breakfast, lunch, dinner, snacks, beverages or other Products.
Meal Plans currently include, but are not limited to:

One-Day Meal Plan
-
Three-Day Meal Plan
-
Five-Day Meal Plan
Nourisher may introduce additional Meal Plans from time to time.
1.9 Order Cut-Off
Order Cut-Off means twenty-four (24) hours before the scheduled delivery date.
Customers may request changes to an order before the applicable Order Cut-Off by contacting Nourisher.
Nourisher will make reasonable efforts to accommodate requested changes. However, changes cannot be guaranteed and remain subject to ingredient availability, stock levels, production planning, kitchen capacity, courier scheduling and other operational circumstances.
1.10 Prepaid Meal Package
A package consisting of multiple scheduled deliveries of Meal Plans purchased and paid for in advance.
Prepaid Meal Packages currently include:

Two-Week Meal Package
-
Four-Week Meal Package
-
Six-Week Meal Package
Prepaid Meal Packages automatically end after all scheduled deliveries have been completed and do not renew automatically.
1.11 Products
Products means all food and beverage products sold by Nourisher, including but not limited to:
-
Meal Plans;
-
Prepaid Meal Packages;
-
Individual meals;
-
Breakfasts;
-
Lunches;
-
Dinners;
-
Snacks;
-
Soups;
-
Broths;
-
Beverages;
-
Curated Boxes;
-
Freezer Bundles;
-
Postpartum collections;
-
Gift Cards;
-
Merchandise;
-
Add-ons; and
-
any other physical products introduced by Nourisher from time to time.
1.12 Professional Partner
A doula, midwife, lactation consultant, birth professional, healthcare professional or other business approved by Nourisher to participate in the Nourisher Partner Programme.
1.13 Services
All services provided by Nourisher, including:
-
delivery services;
-
loyalty programmes;
-
referral programmes;
-
partner programmes;
-
digital services;
-
customer support;
-
and any other services offered from time to time.
1.14 Website
The websites, online shop, mobile applications and digital platforms operated by Nourisher, including www.nourishermeals.com.
2. About Nourisher
2.1
Nourisher develops, prepares and delivers freshly prepared meals, nourishing food products and curated food collections designed to support healthy eating during everyday life and specific life stages, including pregnancy, postpartum recovery and family life.
2.2
Meals are prepared in an approved commercial kitchen operating under a HACCP-compliant food safety management system, in accordance with applicable Dutch and European food safety legislation.
Nourisher follows strict food safety, hygiene, storage and temperature-control procedures throughout production, packaging and delivery.
2.3
Nourisher currently offers, among other things:

Meal Plans;
-
Prepaid Meal Packages;
-
Individual meals;
-
Breakfasts;
-
Lunches;
-
Dinners;
-
Snacks;
-
Broths;
-
Soups;
-
Curated Boxes;
-
Freezer Bundles;
-
Postpartum collections;
-
Gift Cards;
-
Meal Credits;
-
Loyalty rewards;
-
Referral programmes;
-
Professional Partner Programmes;
-
Promotional campaigns; and
-
other Products and Services introduced from time to time.
The availability of Products may vary depending on seasonal ingredients, supplier availability and operational capacity.
2.4
All Products are intended for personal consumption unless expressly agreed otherwise in writing.
Nourisher reserves the right to refuse commercial resale or wholesale purchases.
2.5
Nourisher may introduce new Products, discontinue existing Products or modify recipes, packaging or product offerings where reasonably necessary.
Minor changes resulting from seasonal availability or ingredient sourcing do not constitute a defect.
3. Applicability
3.1
These Terms apply to every Agreement between Nourisher and the Customer.
3.2
By placing an order through the Website, creating an Account or purchasing any Product or Service, the Customer accepts these Terms.
3.3
Any terms or conditions used by the Customer are expressly excluded unless accepted by Nourisher in writing.
3.4
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain fully valid.
The invalid provision shall be replaced with a legally valid provision that most closely reflects its original purpose.
3.5
Nourisher may amend these Terms where reasonably necessary, including to reflect:
-
changes in legislation;
-
operational changes;
-
new Products or Services;
-
technological developments;
-
changes in payment providers; or
-
changes to delivery methods.
Where a material change affects existing Agreements, Customers will be notified before the revised Terms take effect.
3.6
Nothing contained in these Terms limits any mandatory consumer rights under Dutch or European law.
4 Products and Services
4.1
Nourisher offers a range of freshly prepared food products and related services through its Website.
4.2
Products may include seasonal, limited-edition or promotional items.
Availability is not guaranteed and may change without prior notice.
4.3
Where an ordered Product becomes unavailable after an order has been accepted, Nourisher may:
-
replace it with a substantially similar Product of equal or greater value;
-
issue a Meal Credit; or
-
provide a refund for the unavailable Product.
4.4
Images displayed on the Website are intended for illustrative purposes only.
Because meals are freshly prepared using natural ingredients, actual appearance may vary.
4.5
Nutritional values, ingredients and allergen information are provided as accurately as reasonably possible but may change due to supplier or recipe updates.
Customers remain responsible for reviewing current product information before consumption.
4B. Product Availability
Certain Products are seasonal, available for limited periods or offered only while stocks last.
Nourisher reserves the right to modify, substitute or discontinue Products where reasonably necessary due to seasonal availability, supplier changes, ingredient shortages or operational requirements.
Where a Product becomes unavailable after an order has been accepted, Nourisher may offer a suitable substitute of equal or greater value or provide an appropriate refund or Meal Credit.
5. Customer Accounts
5.1
Customers purchasing a Prepaid Meal Package or wishing to manage deliveries, rewards or preferences must create an Account.
5.2
Customers must be at least eighteen (18) years of age.
5.3
Customers are responsible for ensuring that all Account information remains accurate and up to date.
5.4
Accounts are personal and may not be:
-
transferred;
-
shared;
-
sold;
-
duplicated; or
-
created using false information.
5.5
Customers are responsible for maintaining the confidentiality of their login credentials.
5.6
Nourisher reserves the right to suspend or terminate Accounts where fraud, abuse or misuse is reasonably suspected.
6. Orders and Formation of the Agreement
6.1
Orders are placed through the Nourisher Website.
6.2
An order placed by the Customer constitutes an offer to purchase the selected Products.
6.3
An Agreement is concluded only when Nourisher accepts the order by sending an order confirmation.
An automatic order acknowledgement confirming receipt of an order does not constitute acceptance.
6.4
Nourisher reserves the right to refuse or cancel an order where:
-
payment cannot be authorised;
-
Products are unavailable;
-
delivery is not possible;
-
fraud or misuse is reasonably suspected;
-
obvious pricing errors have occurred;
-
quantities exceed normal household consumption; or
-
the Customer has materially breached previous Agreements.
6.5
Nourisher may include complimentary samples, promotional gifts or marketing materials with an order.
Such items are provided without obligation and do not create any entitlement to receive similar items in future orders.
7. One-Time Meal Plans
7.1
Nourisher offers One-Time Meal Plans consisting of carefully curated meals intended to provide complete daily nourishment.
Current Meal Plans include, but are not limited to:

One-Day Meal Plan
-
Three-Day Meal Plan
-
Five-Day Meal Plan
Nourisher may modify, expand or discontinue Meal Plans from time to time.
7.2
One-Time Meal Plans are purchased as individual orders.
Payment is collected in full before preparation and delivery.
7.3
A One-Time Meal Plan constitutes a single Agreement that automatically ends after the ordered Products have been delivered.
7.4
Customers may customise meals included within their Meal Plan where meal selection is available.
Selections must be made before the applicable Modification Deadline.
Where no selection is made, Nourisher may select meals based on availability, dietary preferences or the default weekly menu.
7.5
Additional Products may be added to a One-Time Meal Plan before the applicable Modification Deadline.
These may include, among others:
-
snacks;
-
soups;
-
broths;
-
beverages;
-
desserts;
-
seasonal Products;
-
other available add-ons.
Additional Products are charged separately.
8. Prepaid Meal Packages
8.1
Nourisher offers Prepaid Meal Packages consisting of multiple scheduled deliveries of Meal Plans purchased and paid for in advance.
Current Prepaid Meal Packages include:
-
Two-Week Meal Package;
-
Four-Week Meal Package;
-
Six-Week Meal Package.
8.2
A Prepaid Meal Package is not a subscription.
It does not automatically renew.
Once all scheduled deliveries have been completed, the Agreement automatically ends.
No further payments will be collected unless the Customer places a new order.
8.3
The full purchase price is collected at the time of purchase.
8.4
Customers may customise the meals included in each scheduled delivery before the applicable Modification Deadline.
Where no meal selections have been made, Nourisher may select meals on behalf of the Customer based on availability and dietary preferences.
8.5
Customers may postpone scheduled deliveries before the applicable Modification Deadline.
Requests can be submitted through the Customer Account or by contacting Customer Support.
Nourisher will make reasonable efforts to accommodate postponement requests where operationally possible.
8.6 Cancellation and Refunds
Because each Prepaid Meal Package is prepared specifically for the Customer, Nourisher purchases ingredients, reserves kitchen capacity and schedules production in advance.
For this reason, deliveries included within a Prepaid Meal Package are generally non-refundable once preparation for the relevant delivery has commenced.
Customers who are temporarily unable to receive a scheduled delivery are encouraged to contact Nourisher as soon as possible.
Where reasonably possible, Nourisher may offer an alternative arrangement, including:
-
postponing one or more future deliveries;
-
extending the validity period of the remaining deliveries; or
-
rescheduling future deliveries.
Nothing in this clause limits any mandatory rights granted under Dutch consumer legislation.
8.7
Unless otherwise stated during purchase, unused deliveries included within a Prepaid Meal Package remain valid for twelve (12) months from the date of purchase.
After this period, any remaining unused deliveries may expire without compensation.
9. Meal Selection & Order Cut-Off
9.1
Where meal selection is available, Customers may request changes to meals included within their order up to the applicable Order Cut-Off.
9.2
Meal change requests may be submitted through the Customer Account or by contacting Nourisher Customer Support.
9.3
Nourisher will make reasonable efforts to accommodate requested meal changes.
However, requested changes cannot be guaranteed and remain subject to:
-
ingredient availability;
-
stock levels;
-
production planning;
-
kitchen capacity;
-
courier scheduling;
-
operational feasibility.
9.4
Where no meal selection has been submitted before production commences, Nourisher may select meals on behalf of the Customer based on dietary preferences, Product availability and the weekly menu.
9.5
Additional Products may be requested before the applicable Order Cut-Off.
Availability cannot be guaranteed and depends on stock levels and production capacity.
9.6
If a requested Product becomes unavailable after production planning has commenced, Nourisher may substitute it with a substantially similar Product of equal or greater value or, where appropriate, provide a Meal Credit or refund for the unavailable Product.
10. Delivery
10.1
Nourisher currently delivers within selected regions of the Netherlands.
Delivery availability depends on postcode coverage and operational capacity.
10.2
Delivery windows communicated by Nourisher are estimates only.
While Nourisher aims to deliver within the communicated delivery window, delivery times cannot be guaranteed.
10.3
Delays may occur due to circumstances beyond Nourisher's reasonable control, including but not limited to:
-
traffic;
-
adverse weather conditions;
-
supplier delays;
-
road closures;
-
technical failures;
-
force majeure.
Reasonable delays do not entitle the Customer to compensation.
10.4
Customers are responsible for ensuring that the delivery address is correct and accessible.
Changes to the delivery address must be submitted before the applicable Modification Deadline.
10.5
Customers may authorise Nourisher to:
-
leave an order in a designated safe place;
-
deliver to neighbours;
-
deliver to an alternative address approved by the Customer.
Where such instructions have been provided, delivery shall be deemed completed once the Products have been delivered in accordance with those instructions.
From that moment onwards, the Products are at the Customer's risk.
10.6
Where delivery cannot be completed because of:
-
an incorrect address;
-
inaccessible premises;
-
incorrect delivery instructions; or
-
the Customer's absence,
Nourisher is not obliged to provide a replacement or refund.
Additional delivery charges may apply where redelivery is requested.
10.7
Meals should be refrigerated immediately after delivery.
Where the Customer instructs Nourisher to leave Products unattended, the Customer assumes responsibility for ensuring appropriate refrigeration after delivery.
10.8
Nourisher prepares, stores, transports and delivers Products in accordance with its HACCP-compliant food safety management system.
10B. Inspection of Products
Customers should inspect their order as soon as reasonably possible after delivery.
Any visible shortages, damage or quality concerns should be reported to Nourisher promptly after delivery so that we can investigate and, where appropriate, provide a suitable solution.
11. Prices
11.1
All prices displayed on the Website include VAT unless otherwise stated.
Delivery charges, where applicable, are displayed during checkout.
11.2
Premium Products, limited editions and certain add-on Products may carry an additional charge.
11.3
Nourisher reserves the right to modify prices at any time.
Price changes do not affect orders that have already been accepted.
11.4
If an obvious pricing error has occurred, Nourisher reserves the right to cancel the affected order before dispatch.
Where payment has already been collected, the Customer will receive a full refund.
12. Payment
12.1
Payment must be made using one of the payment methods offered during checkout.
Available payment methods may change from time to time.
12.2
Customers are responsible for ensuring that payment information remains accurate and up to date.
12.3
By placing an order, the Customer authorises Nourisher and its payment providers to collect payment using the selected payment method.
12.4
If a payment cannot be processed because of insufficient funds, expired payment details or another payment issue, Nourisher may:
-
retry the payment;
-
contact the Customer;
-
suspend outstanding deliveries until payment has been received; or
-
recover outstanding amounts through lawful collection procedures.
12.5
If payment remains overdue after reminder, Nourisher may charge statutory interest and reasonable collection costs to the extent permitted by Dutch law.
12.6
Customers should contact Nourisher before initiating a payment dispute or chargeback.
Where a chargeback is initiated without valid legal grounds, Nourisher reserves the right to suspend future orders, Meal Credits, loyalty rewards and participation in promotional programmes while the dispute is investigated.
13. Meal Credits
13.1
Nourisher may issue Meal Credits as part of promotional campaigns, customer service resolutions, loyalty rewards, referrals or other marketing initiatives.
Meal Credits are issued solely at Nourisher's discretion unless otherwise stated.
13.2
Meal Credits:
-
have no monetary value;
-
cannot be exchanged for cash;
-
cannot be refunded;
-
cannot be transferred to another person or account unless expressly authorised by Nourisher.
13.3
Meal Credits may only be redeemed towards eligible purchases made through the Nourisher Website.
Meal Credits cannot be used to purchase Gift Cards unless expressly stated otherwise.
13.4
Unless otherwise stated when issued, Meal Credits remain valid for twelve (12) months from the date of issue.
Expired Meal Credits automatically lapse and cannot be reinstated.
13.5
Where an order paid wholly or partly using Meal Credits is cancelled or refunded, Nourisher may determine whether the corresponding Meal Credits will be reissued.
13.6
Nourisher reserves the right to withdraw, suspend or cancel Meal Credits obtained through:
-
fraud;
-
abuse;
-
multiple customer accounts;
-
referral manipulation;
-
payment disputes;
-
technical errors;
-
or any misuse of the Website or promotional programmes.
14. Gift Cards
14.1
Nourisher may offer digital or physical Gift Cards.
Gift Cards may only be redeemed through the Nourisher Website.
14.2
Gift Cards may only be used until their available balance has been exhausted.
Unused balances remain available until the Gift Card expires, where an expiry date applies.
14.3
Gift Cards:
-
cannot be exchanged for cash;
-
cannot be reloaded unless expressly stated;
-
cannot be replaced where lost, stolen or used without authorisation unless required by law.
14.4
Gift Cards purchased through unauthorised third parties may be refused.
14.5
Nourisher reserves the right to refuse redemption where fraud or misuse is reasonably suspected.
15. Promotions & Discount Codes
15.1
Nourisher may offer promotional discounts, introductory offers, seasonal campaigns, bundle offers and other promotional incentives.
15.2
Unless expressly stated otherwise, promotions:
-
cannot be combined;
-
cannot be exchanged for cash;
-
cannot be transferred;
-
apply only during the stated promotional period.
15.3
Discount codes must be entered during checkout.
Codes cannot normally be applied after an order has been placed.
15.4
Some Products may be excluded from promotional discounts, including but not limited to:
-
Gift Cards;
-
selected Curated Boxes;
-
limited editions;
-
promotional bundles.
15.5
Promotions may be withdrawn or amended at any time where reasonably necessary, provided this does not affect completed purchases.
15.6
Nourisher reserves the right to cancel promotional discounts obtained through fraud, abuse or technical errors.
16. Nourish & Earn Loyalty Programme
16.1
Nourisher may operate a customer loyalty programme known as Nourish & Earn.
Participation is free of charge.
16.2
Customers may earn points by completing eligible activities, including but not limited to:
-
creating a Nourisher Account;
-
placing eligible orders;
-
following Nourisher on social media;
-
participating in promotional campaigns;
-
completing other activities designated by Nourisher.
The number of points awarded for each activity may change from time to time.
16.3
Points may be redeemed for rewards made available through the Nourish & Earn programme.
Available rewards may change from time to time.
16.4
Once redeemed, points are converted into a unique promotional code or other reward issued through the Nourish & Earn platform.
16.5
Loyalty points:
-
have no cash value;
-
cannot be transferred between Customers;
-
cannot be sold;
-
cannot be exchanged for money.
16.6
Unless otherwise communicated, loyalty points expire twelve (12) months after they are earned.
Expired points automatically lapse.
16.7
Nourisher reserves the right to correct incorrectly awarded points resulting from:
-
technical errors;
-
administrative errors;
-
fraud;
-
abuse;
-
system failures.
16.8
Nourisher may suspend or terminate participation in the Nourish & Earn programme where fraud, abuse or misuse is reasonably suspected.
16.9
Nourisher reserves the right to amend, suspend or discontinue the Nourish & Earn programme at any time.
Such changes shall not affect rewards already redeemed before the effective date of the change.
17. Referral Programme
17.1
Nourisher may offer referral programmes through which existing Customers may invite new Customers to purchase Nourisher Products.
17.2
Unless otherwise stated during the promotion:
-
the referred Customer receives a €5 discount on their first eligible order; and
-
the referring Customer receives €5 in Meal Credits after the referred Customer has successfully completed and paid for their first eligible order.
Nourisher reserves the right to amend referral rewards at any time for future referrals.
17.3
Referral rewards are only granted where:
-
the referred Customer is genuinely new to Nourisher;
-
the referred Customer has never previously placed an order;
-
payment has been successfully received.
17.4
Self-referrals are strictly prohibited.
Customers may not refer themselves using another email address, payment method or account.
17.5 Referral Eligibility
Referral rewards are intended solely for genuine personal recommendations.
Only one referral reward may be granted per household.
For the purpose of fraud prevention, Nourisher may determine household eligibility using information including, but not limited to:
-
delivery address;
-
billing address;
-
email address;
-
payment method;
-
telephone number;
-
account history; and
-
other information reasonably required to prevent abuse.
Self-referrals and the creation of multiple Accounts to obtain referral rewards are strictly prohibited.
17.6
Customers may not create multiple Accounts for the purpose of obtaining referral rewards.
17.7
Nourisher reserves the right to withhold, cancel or recover referral rewards obtained through:
-
fraud;
-
abuse;
-
false identities;
-
multiple Accounts;
-
automated referrals;
-
misleading promotions;
-
or other attempts to manipulate the Referral Programme.
18. Professional Partner Programme
18.1
Nourisher may operate a Professional Partner Programme for approved:
-
doulas;
-
midwives;
-
lactation consultants;
-
birth professionals;
-
healthcare professionals;
-
and other approved partners.
18.2
Participation is subject to Nourisher's approval.
Nourisher may approve or decline applications at its sole discretion.
18.3
Approved Partners receive:
-
a personalised referral code;
-
promotional materials;
-
printed referral cards or flyers;
-
information about Nourisher Products;
-
and other marketing resources determined by Nourisher
18.4
Clients purchasing through a Partner's referral code receive the promotional discount communicated at the time of purchase.
Unless otherwise communicated, the current client benefit is 10% off eligible Nourisher orders.
18.5
Partners receive a referral reward for each qualifying order placed using their personal referral code.
Unless otherwise communicated:
-
Partners may choose between €15 in Nourisher Meal Credits or a €10 cash payment for each qualifying order.
-
Rewards are paid quarterly.
-
Reward amounts may be amended by Nourisher for future referrals.
18.6
Referral rewards become payable only after:
-
the Customer's payment has been successfully received;
-
the order has been fulfilled;
-
no refund has been issued; and
-
no payment dispute or chargeback has occurred.
18.7
Partners are independent businesses or professionals.
Participation in the Partner Programme does not create an employment relationship, agency relationship, joint venture or partnership with Nourisher.
18.8
Partners may not:
-
represent themselves as employees of Nourisher;
-
make medical claims on behalf of Nourisher;
-
modify Nourisher marketing materials without written permission;
-
engage in misleading, unlawful or unethical marketing.
18.9
Nourisher reserves the right to suspend or terminate participation in the Partner Programme where fraud, misuse or conduct that may reasonably damage Nourisher's reputation is identified.
18.10
Partners remain independent businesses or professionals.
Partners are solely responsible for complying with all applicable professional, advertising, tax and regulatory obligations relating to their own business activities.
Nothing in the Partner Programme creates an employment relationship, agency, partnership or joint venture between Nourisher and the Partner.
19. Order Changes, Cancellations & Right of Withdrawal
19.1 Order Changes
Customers may request changes to an order up to twenty-four (24) hours before the scheduled delivery date ("Order Cut-Off").
Requests should be submitted by contacting Nourisher.
Nourisher will make reasonable efforts to accommodate requested changes.
However, changes cannot be guaranteed and remain subject to:
-
ingredient availability;
-
stock levels;
-
production planning;
-
kitchen capacity;
-
courier scheduling;
-
operational feasibility.
19.2 Cancellation Before the Order Cut-Off
Customers may cancel an order without charge before the applicable Order Cut-Off.
Where payment has already been collected, approved refunds will be processed using the original payment method where reasonably possible.
19.3 Cancellation After the Order Cut-Off
After the applicable Order Cut-Off, Nourisher begins purchasing ingredients, allocating kitchen capacity and scheduling production for the Customer's order.
Because Nourisher prepares fresh, refrigerated and perishable food products specifically for its Customers, orders generally cannot be cancelled after the Order Cut-Off, and the Customer remains responsible for payment.
Customers experiencing exceptional circumstances are encouraged to contact Nourisher.
Although Nourisher cannot guarantee that requests can be accommodated after the Order Cut-Off, we will consider reasonable requests in good faith where operationally possible.
19.4 Prepaid Meal Packages
Customers who are temporarily unable to receive a scheduled delivery included within a Prepaid Meal Package should contact Nourisher as soon as possible.
Where reasonably possible, Nourisher may offer an alternative arrangement, including postponing or rescheduling future deliveries.
As ingredients are purchased and production capacity is reserved specifically for each delivery, unused deliveries are generally non-refundable once preparation for the relevant delivery has commenced.
Nothing in this clause limits mandatory rights granted under Dutch consumer legislation.
19.5 Statutory Right of Withdrawal
Under Articles 6:230o and 6:230p of the Dutch Civil Code (Burgerlijk Wetboek), consumers generally have a statutory fourteen (14) day right of withdrawal for distance purchases.
However, this statutory right does not apply to contracts relating to the supply of goods that:
-
are liable to deteriorate or expire rapidly;
-
are produced according to the consumer's specifications; or
-
cannot be returned for reasons of health protection or hygiene after delivery.
As Nourisher supplies freshly prepared and perishable food products, Customers generally do not have a statutory right of withdrawal once the Agreement has been concluded and preparation has commenced.
20. Food Safety, Allergens & Nutrition
20.1 Food Safety
Nourisher prepares, stores and distributes all Products in accordance with its HACCP-compliant food safety management system and complies with all applicable Dutch and European food safety legislation.
Meals are prepared in an approved commercial kitchen under strict hygiene, storage and temperature-control procedures.
20.2 Storage & Handling
Customers should refrigerate Products immediately upon delivery and follow all storage, preparation and heating instructions supplied with the Products.
Failure to follow these instructions may affect the quality and safety of the Products.
20.3 Delivery Risk
Where the Customer instructs Nourisher to leave Products unattended or at a designated safe place, responsibility for the Products transfers to the Customer once delivery has been completed in accordance with those instructions.
Nourisher cannot be held responsible for any deterioration in quality resulting from delayed refrigeration, improper storage or circumstances occurring after successful delivery.
20.4 Allergens
While Nourisher takes great care in preparing Products and providing accurate ingredient information, Products are prepared in commercial kitchen facilities where allergens are handled.
Accordingly, Nourisher cannot guarantee that any Product is completely free from traces of allergens or cross-contamination.
Customers with food allergies, intolerances or other dietary requirements remain responsible for reviewing the ingredient and allergen information provided before consumption and should contact Nourisher if they require further information.
20.5 Nutritional Information
Nutritional values, ingredient lists and dietary information are provided for general information only.
Although Nourisher makes reasonable efforts to ensure accuracy, nutritional values may vary due to natural ingredients, seasonal variation and supplier changes.
20.6 Health Disclaimer
Nourisher Products are developed to support healthy eating and wellbeing, including during pregnancy and the postpartum period.
However, Nourisher Products are not intended to diagnose, treat, cure or prevent any disease and do not constitute medical, nutritional or healthcare advice.
Individual results may vary.
Customers should consult a qualified physician, midwife, dietitian or other healthcare professional regarding individual dietary requirements, allergies, medical conditions or health concerns.
20.7 Packaging
Nourisher continually seeks to improve the sustainability, food safety and efficiency of its packaging.
Accordingly, packaging materials, insulation, cooling materials and presentation may change from time to time without prior notice, provided such changes do not materially affect the quality or nature of the Products.
21. Customer Responsibilities
21.1
Customers are responsible for providing complete and accurate information when placing an order, including delivery details, contact information and any other information required for fulfilment of the Agreement.
21.2
Customers are responsible for ensuring that someone is available to receive the delivery where required or that any delivery instructions provided are suitable and accurate.
21.3
Customers should carefully review all Product information, including ingredient lists, allergen information, storage instructions, heating instructions and use-by dates before consuming any Product.
21.4
Customers are responsible for storing Products appropriately after delivery.
21.5
Customers may not misuse the Website or any of Nourisher's Services, including by:

creating multiple Accounts to obtain promotional benefits;
-
interfering with the operation or security of the Website;
-
submitting false or misleading information;
-
using automated systems to place orders;
-
or engaging in fraudulent or unlawful activities.
21.6 Product Storage
Customers are responsible for ensuring that Products are stored safely after delivery and are not consumed after the stated use-by date.
22. Privacy & Communications
22.1
Nourisher processes personal data in accordance with its Privacy Policy and applicable privacy legislation, including the General Data Protection Regulation (GDPR).
The Privacy Policy forms an integral part of these Terms.
22.2
Nourisher may use Customer information for purposes including:
-
processing orders;
-
arranging deliveries;
-
customer support;
-
payment processing;
-
fraud prevention;
-
administering loyalty and referral programmes;
-
complying with legal obligations.
22.3
Where permitted by law, Nourisher may send Customers communications relating to their orders, Products, promotions, newsletters and other marketing activities.
Customers may unsubscribe from marketing communications at any time using the unsubscribe link or by contacting Nourisher.
Operational communications relating to existing orders or customer accounts will continue where necessary for the performance of the Agreement.
22.4 Electronic Communications
By creating an Account or placing an order, Customers agree that agreements, invoices, order confirmations, notices and other communications relating to their purchases may be provided electronically.
Electronic communications satisfy any legal requirement that such communications be made in writing, to the extent permitted by applicable law.
23. Reviews, Testimonials & User Content
23.1
Customers may voluntarily submit reviews, testimonials, photographs, videos or other content relating to Nourisher or its Products.
23.2
Where Customers voluntarily submit such content directly to Nourisher or give permission for its use, Customers grant Nourisher a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish, display and adapt that content for marketing, promotional and informational purposes.
Nothing in this clause transfers ownership of the Customer's content to Nourisher.
23.3
Nourisher will not use identifiable photographs or videos of Customers in marketing materials without any consent required under applicable law.
24. Fraud & Abuse
24.1
Nourisher is committed to maintaining a fair and secure shopping experience for all Customers.
We reserve the right to investigate any Account, order, transaction or promotional activity where fraud, abuse or misuse is reasonably suspected.
24.2
Examples of prohibited conduct include, but are not limited to:
-
creating multiple Customer Accounts;
-
self-referrals;
-
creating Accounts on behalf of another person without permission;
-
manipulating loyalty rewards;
-
manipulating referral rewards;
-
using false identities;
-
using false payment details;
-
attempting to exploit pricing or technical errors;
-
abusing promotional campaigns;
-
fraudulent payment disputes or chargebacks;
-
reselling Products without written permission.
24.3
Nourisher may use information including, but not limited to:
-
delivery addresses;
-
billing addresses;
-
email addresses;
-
payment methods;
-
telephone numbers;
-
IP addresses;
-
order history;
-
device information;
to investigate suspected abuse or fraud.
Such processing will always be carried out in accordance with applicable privacy legislation.
24.4
Where fraud or abuse is reasonably established, Nourisher may:
-
refuse or cancel orders;
-
suspend or terminate Customer Accounts;
-
revoke Meal Credits;
-
revoke loyalty rewards;
-
revoke referral rewards;
-
terminate participation in promotional programmes;
-
refuse future purchases where legally permitted.
24.5
Nourisher reserves the right to recover any financial losses resulting from fraudulent conduct through all lawful means.
25. Liability
25.1
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
25.2
Subject to mandatory law, Nourisher shall only be liable for direct damages resulting directly from an attributable failure to perform its obligations under the Agreement.
25.3
To the fullest extent permitted by law, Nourisher shall not be liable for indirect or consequential damages, including but not limited to:
-
loss of profit;
-
loss of income;
-
loss of business opportunity;
-
indirect financial losses;
-
emotional distress;
-
consequential damages.
25.4
Nourisher shall not be liable for damage resulting from:
-
inaccurate information provided by the Customer;
-
incorrect delivery instructions;
-
delayed refrigeration after delivery;
-
failure to follow storage instructions;
-
failure to follow heating instructions;
-
improper handling of Products after delivery;
-
known allergies or dietary restrictions where ingredient information was available.
25.5
Nourisher shall not be liable for temporary interruptions to the Website resulting from:
-
maintenance;
-
technical failures;
-
cyber incidents;
-
internet outages;
-
third-party service providers.
25.6
Nothing in these Terms limits the Customer's mandatory statutory rights.
26. Force Majeure
26.1
Nourisher shall not be liable for any failure or delay in performing its obligations where such failure results from circumstances beyond its reasonable control.
26.2
Force majeure includes, but is not limited to:
-
natural disasters;
-
flooding;
-
severe weather conditions;
-
fire;
-
pandemics;
-
epidemics;
-
government measures;
-
strikes;
-
labour shortages;
-
supplier shortages;
-
transport disruptions;
-
road closures;
-
power failures;
-
cyber-attacks;
-
telecommunications failures;
-
ingredient shortages;
-
food recalls;
-
contamination incidents;
-
failures of third-party logistics providers; and
-
any other event beyond Nourisher's reasonable control.
26.3
Where a force majeure event occurs, Nourisher may suspend, delay or cancel affected deliveries without liability.
Where appropriate, Customers may receive an alternative delivery date or another reasonable solution.
27. Intellectual Property
27.1
All intellectual property rights relating to the Website, Products and Services remain the exclusive property of Nourisher or its licensors.
27.2
This includes, but is not limited to:
-
recipes;
-
product concepts;
-
meal plans;
-
photographs;
-
videos;
-
graphics;
-
logos;
-
trademarks;
-
designs;
-
website content;
-
text;
-
software;
-
source code;
-
marketing materials.
27.3
Customers may use the Website solely for personal, non-commercial purposes.
No part of the Website or its content may be copied, reproduced, distributed, modified or commercially exploited without Nourisher's prior written permission.
27.4
Nothing in these Terms transfers any intellectual property rights to the Customer.
28. Complaints
28.1
Nourisher strives to provide high-quality Products and Services.
If a Customer is dissatisfied, we encourage them to contact Customer Support as soon as reasonably possible after discovering the issue.
28.2
Complaints should include sufficient information to allow Nourisher to investigate, including where applicable:
-
order number;
-
delivery date;
-
photographs;
-
description of the issue.
28.3
Nourisher aims to acknowledge complaints promptly and provide a substantive response within five (5) business days, although more complex matters may require additional time.
28.4
Where a complaint is found to be justified, Nourisher may offer an appropriate remedy, which may include:
-
replacement Products;
-
Meal Credits;
-
partial refund;
-
full refund;
-
or another reasonable solution.
28.5
If a Customer is not satisfied with the handling of a complaint, they may submit their complaint through the European Online Dispute Resolution (ODR) platform, where available, or pursue any other remedies available under applicable law.
29. Governing Law & Dispute Resolution
29.1
These Terms and all Agreements between Nourisher and the Customer shall be governed exclusively by Dutch law.
29.2
Nothing in these Terms limits any mandatory consumer rights under Dutch or European legislation.
29.3
Any dispute arising out of or relating to these Terms or an Agreement shall be submitted to the competent Dutch court, unless mandatory law requires otherwise.
30. Miscellaneous Provisions
30.1
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain fully effective.
The invalid provision shall be replaced by a legally valid provision that most closely reflects the original intent.
30.2
Failure by Nourisher to enforce any provision of these Terms shall not constitute a waiver of that provision or any other rights.
30.3
These Terms constitute the entire agreement between Nourisher and the Customer regarding the purchase of Products and Services.
30.4
Headings are included for convenience only and do not affect the interpretation of these Terms.
30.5
These Terms are drafted in English. Where Nourisher provides translations for convenience, the English version shall prevail to the extent permitted by applicable law. If you intend to rely on Dutch law and primarily sell to Dutch consumers, I recommend also publishing an official Dutch version. In case of conflict between language versions, mandatory Dutch consumer law will prevail where applicable.
